Fort Lauderdale Criminal Lawyer: Drug Trafficking: Explanation for absconding (Failure to report for substantial assistance)

A recent question submitted from Fort Lauderdale involved a defendant’s violation of a substantial assistance agreement entered into with the State Attorney’s office. The question posed was whether a defendant who had previously pled guilty to a crime and then absconded should be given an opportunity to explain why he had become a fugitive prior to sentencing? It should be noted that this plea was in order to facilitate his participating in substantial assistance in exchange for leniency.

Answer:
A defendant absolutely has the right to explain to the court why he or she absconded after failing to adhere to the terms of an agreement entered into with the State. This right of explanation is not, however, entitled to a defendant in order to establish mitigation but rather to determine whether or not there was a justifiable excuse in failing to appear for scheduled court hearings or to meet with law enforcement officers in order to provide substantial assistance. Failure to allow defense counsel an opportunity to determine whether or not there was a legally sufficient excuse for a defendant’s failure to appear will result in a remand for a new hearing affording the defendant the right to provide any excuses for his failure to appear.

Police in Fort Lauderdale Search for Armed Burglar

FORT LAUDERDALE, FLORIDA – Last Thursday, a burglar broke into a Lake Ridge townhouse, shot the family dog, attempted to carjack a woman and her daughter, then fired at the woman’s husband before fleeing the scene. The crime unfolded around 9pm in the 1000 block of Northeast 17th Way, according to spokesperson Detective Kathy Collins.

When the burglar broke into the townhouse, he was greeted a Labrador retriever named Jake. After the dog barked and alerted its owner, the burglar shot Jake once in the head, killing him before taking off. Police rush to the home where the shooting occurred, then answered a second call about an armed carjacking nearby.

As he tried to escape, the burglar pushed a mother and her 11-year-old daughter out of their car and tried to drive away in their Ford Mustang. When the woman’s husband opened the front door, the burglar shot at him, but struck a car instead.

Broward County police are for assistance from the public in identifying and tracking down the suspect. No description was available.

South Florida Men Found Guilty in Beating Death

FORT LAUDERDALE, FLORIDA – On Friday, a jury convicted two South Florida men in the 2006 beating death of a homeless man. Brian Hooks, 21, and Thomas Daugherty, 19, were teenagers at the time of the beating, and surveillance videos of the incident ignited outrage among homeless advocates around the county. The videos show Hooks and Thomas beating a homeless men with baseball bats as the man tries to sleep on a park bench.

Prosecutors sought first-degree murder charges, but after deliberating for nine hours over the course of two days, the jury convicted the two of second-degree murder and two counts each of attempted second-degree murder. They await sentencing, which could be as much as life in prison. Because Daugherty was 17 at the time of the beatings, he was not eligible for capital punishment.

In May, William Ammons, 21, pleaded guilty to felony murder and aggravated assault for the same incident. He had also testified again Daugherty and Hooks, but criminal defense attorneys claimed his inconsistent statements invalidated his testimony. Ammons has admitted lying to police 80 times.

Fort Lauderdale Shooting Victims

FORT LAUDERDALE, FLORIDA – The South Florida Sun-Sentinel reported on a gunman who shot two nighttime bicyclists last week. One bicyclist was killed and another ended up at Broward General Medical Center in critical condition. The shooting occurred in the 500 block of Northeast Third Avenue around mid-morning on Thursday. Police said the victims were Angel Velasquez, 24, of Fort Lauderdale and Velasquez’s 34-year-old friend.

The older bicyclist died, and police are waiting to notify his relatives before they release the person’s name. A spokesperson for the Fort Lauderdale police said that detectives do not know what triggered the shooting or who might have been responsible.

Another Fort Lauderdale shooting occurred in the 1200 block of Northeast Fifth Terrace, injuring Marckenzy Nelson, 21, of Fort Lauderdale. Nelson has a history of cocaine-dealing arrests and had been on probation since earlier this year, when he pleaded no contest to a charge of battery of a law enforcement officer.

Officials say a newer model white SUV was spotted in the area soon after Nelson was shot. Detectives are still searching for this vehicle and potential suspects.

Jaguars Player Arrested at Miami Beach Club

In Florida, the Orlando Sentinel recently reported that Jaguars running back Fred Taylor has been charged with disorderly conduct. Taylor was arrested early on a Saturday night in August near Club Cristal in Miami Beach.

According to Miami Beach police spokesperson Juan Sanchez, police released Taylor after he promised to appear in court. A spokesperson for the Jaguars said the football team declined to comment on Taylor’s arrest.

This incident comes soon after former Jaguars player Jimmy Smith was arrested in Jacksonville and charged with DUI, having an open container, and possession of marijuana. He was suspended from four games in 2003 for drug use.

Taylor himself has a few previous run-ins with the law. As a Florida student, he and three teammates were charged in 1995 with using the number off a credit card receipt and illegally charging pizza on the card. The following year, he was charged with petty theft and got suspected for four games.

One Judges Fight Against Fashion

When I heard about this, I silently laughed to myself. Keep in mind that the inmate uniforms were issued by the department of corrections. If enough delay was caused by this, it would be interesting to see if criminal defense attorneys might be able to file some appropriate motions on behalf of their clients (i.e. right to speedy trial, due process).

HILLSBOROUGH COUNTY, Florida - Friday, September 12, 2008 – Circuit Judge Daniel Perry sent 71 inmates out of the courtroom on Wednesday. Thursday, he sent 39 more out. Seems these people like to wear their pants with their butts showing, but Judge Perry will have no showing off of the butt in his domain. Wearing the pants low seems to be all the rage among the younger set in Tampa. A source in Tampa has been in and out of the courthouse thousands of times over the past four or five years, and has seen people walking to the courtroom with their pants hanging down. She’s often wondered what the world was coming to, allowing saggy pants – which look very sloppy – in the courtroom.

Now it seems that inmates have figured out a way to get saggy pants. According to Bay News 9, officials with the sheriff’s office said some deputies issued some inmates uniforms that are too big. They will be rectifying the problem by making sure all the inmates get uniforms that fit properly.

Judges in Broward, Dade and Palm Beach County have been known to excuse defendants from a courtroom when not dressed appropriately, however, not when the clothes were issued by the department.

Fullwood DNA Nabs Possible Killer

NORTH PORT, FLORIDA, Saturday, September 13, 2008

A man by the name Patrick Dewayne Murphy has been charged with kidnapping, sexual assault and murder in the death of Coralrose Fullwood (a six year old). The DNA found under her fingertips shows that she was alive when Murphy came into contact with her, and that she possibly fought for her life.

The Court has not yet appointed an attorney for Murphy. He could face the death penalty, thus limiting the number of criminal defense attorneys qualified to represent him. The DNA acts as an eyewitness to the case. It is possible for Murphy to get a lesser sentence or to be acquitted if the DNA was not handled properly. Experts from Broward County Florida are expected to review the method evidence was collected later this week.

Fort Lauderdale Man Shot, Suspect Unknown

According to the Sun-Sentinel in Florida, a Fort Lauderdale man was struck by gunfire earlier this week. According to reports, shots were fired around 5:30am on Monday morning when Marchenzy Nelson was standing out 1243 NE Fifth Terrace.

The 22-year-old shooting victim is listed in critical condition at Broward County General Medical Center.

A spokesperson for the Broward County police told the Sentinel that a newer-model white SUV was last seen leaving the area. Police think the vehicle may have been a Jeep Grand Cherokee, but they have not released other details on this Fort Lauderdale shooting. So far, no criminal charges have been filed.

Those with information on this shooting are asked to call Broward County Crime Stoppers at 954-493-TIPS (8477).

Florida Man Arrested for Workers’ Comp Fraud

The Tallahassee man who was allegedly behind one of South Florida’s biggest check-cashing operations was arrested last week. Florida’s Department of Financial Services (DFS) reports that it has filed over a hundred charges against Christiano Leonardo Gloria. Gloria was allegedly involved in a premium fraud that set up shell construction companies and deceived insurance companies by applying for certificates of insurance on behalf of employees.

This plot gave certificates of insurance dozens of subcontractors and hundreds of employees, many of them undocumented workers. In actuality, none of these employees or subcontractors worked for the shell companies. Instead, they paid a fee to use the certificates of the shell companies.’

Among the shell companies were WM South Florida Construction, which according to the DFS defrauded the Florida Citrus Business and Industries Fund out of more than half a million dollars in premiums. Gloria is accused of laundering payroll money through money transmitters in South Florida.

Palm Beach Criminal Lawyer: Stolen Cars Sold for Scrap

The five men have been accused of stealing cars and selling them to junkyards, including Bartow Auto Salvage and a junkyard in Lakeland. They get a whopping $10.00 per 100 pounds. Out of the 800 cars that have been inspected at Bartow Auto Salvage, 31 were stolen. Ten of those have been crushed for scrap. There were two stolen vehicles found in the Lakeland junkyard.

Thus far, only Henry (19), Ponder (18) and Terrell (19) – all of Winter Haven, FL - have been caught and arrested. There are warrants out for Washington (30) and Richardson (20).

There is an ongoing investigation into this matter. Of course, anyone with information on Washington and Richardson can call the crime stoppers hotline at 1-800-226-TIPS.

Four South Florida Men Charged in Retail Theft and Resale Ring

Last week the Miami Herald reported that the United State Attorney’s office unsealed an indictment returned by a Fort Lauderdale federal grand jury charging several people in a large-scale conspiracy.

Four South Florida men and three people from North Carolina were charged for their involvement in this multi-million dollar retail operation, which include the interstate transportation of merchandise from Target, CVS, and other retailers. The products were transported to a warehouse in South Florida, where they were repackaged and resold, generating about $7.9 million.

The defense attorney for one the accused claims his client believed the goods were discontinued or damaged and had no knowledge that they were stolen. The FBI estimates that this case is part of a larger trend in retail theft, making up roughly $30 billion in retail losses annually.

DAYTONA BEACH, September 3, 2008 – After a prostitute with leg and face injuries showed up at Halifax Health Medical Center last night, police are looking for her attacker.

The unidentified woman was attacked behind the Water Club, and told police that the assailant ran over her leg when he tried to flee the area after attacking her. She stated that she bit her assailant to get away. The man is described as a 6-foot tall white male, short, sandy-brown hair, tanned and has many tattoos on his forearms. He was driving a boxy car (like a Caprice Classic or a Crown Victoria) with a tan leather interior. The car is alleged to be rusty with primer on it.

"Exposure in Hillsborough County"

In two separate incidents Monday, September 01, 2008, two different men were arrested after exposing themselves.

At about 7:00 p.m. Sunday night, Raymond Leroy James, who is registered as a sexual offender, was arrested for exposing himself to two girls. The girls are 8 and 10 years old. Allegedly, James exposed himself and performed sexual acts on himself in front of the girls, then gave the older girl a piece of paper that had his phone number on it. When the girls told adults in their homes, several of them chased and held James until the sheriff’s deputies arrived on the scene. James remains in Faulkenburg Road Jail on one count of exposure of sexual organs ($500 bond), one count of lewd and lascivious exhibition ($7,500 bond) and one count lewd and lascivious exhibition (parole violation).

The other arrest happened three hours later at Bobalouie’s Bar.

Shedrick Reshord Jenrette
, 30, was arrested for exposing himself and performing sexual acts on himself in front of customers and employees. Jenrette, charged with one count of exposure of sexual organs, is being held at Orient Road Jail on a $500 bond.

Both men denied any wrongdoing.

Palm Beach Criminal Attorney: Teenage Sex Crime and Alcohol

Was the following sentence lenient?

BOCA RATON, September 3, 2008 - An alcohol-laden sexual assault on two girls on New Year’s day has four of six teenagers pleading to lesser charges that do not fall under the Sex Crimes statutes. Ryan Lafferty, Blake Carter (both 14), Alex Perriello, 16, and Eduardo Otaegui, 18 all pleaded to felony battery instead of sexual battery on a helpless person and lewd and lascivious battery.

The teenagers will also receive five years of probation. The first year will be spent on house arrest. These boys got lucky, as the judge agreed to withhold adjudication if they complete the probation. That means their record may be eligible for sealing at a later date.

They must also complete a substance abuse and psycho-sexual evaluation and any other treatment recommended by psychological evaluators. They are also subject to drug and alcohol tests and are prohibited from using any kind of narcotics or drinking alcohol. They may not have any unsupervised contact with girls younger than 18 years of age, but may participate in classroom activities, verbal greetings in class and the lunchroom. They will not be allowed to attend the same school as the girls they committed the assault on.

The two girls they abused were 14 and 15 years old.

One co-defendant – William Long, 19 – did not accept the plea agreement. The offer remains open until Monday.

There is a possibility that all parties involved know each other and that there has been other sexual contact between them.

DEBARY, September 3, 2008 – A deputy who was checking into some missing bikes attempted to make contact with residents who had what appeared to be numerous abandoned bicycles on their property. No one would answer the door – and he smelled raw cannabis - so he went around the house and saw an open window. The smell of raw cannabis got stronger. He announced himself through the open window.

When he went inside, he found Kathryn Miller, 41, Thomas Miller, 58 and Wayne Miller, 20 – and 40 marijuana plants. He also found 1,762 grams of marijuana in the freezer. The drugs are allegedly worth $42,000. There were also two minors in the home – a 10-year-old girl and a 17-year-old boy.

Kathryn is being held in Indian Lake Jail on a $70,500 bond and is charged with cultivation of marijuana, possession of marijuana with intent to distribute, possession of drug paraphernalia, cultivation of marijuana with children present and child abuse.

Thomas Miller is being held in Branch Jail on a $70,500 bond and is charged with cultivation of marijuana, possession of marijuana with intent to distribute, cultivation of marijuana with children present, child abuse and possession of drug paraphernalia.

Wayne Miller is being held in Branch Jail on a $40,500 bond and is charged with cultivation of marijuana, possession of marijuana with intent to distribute and possession of drug paraphernalia.

Florida Man Accused in Double Murder Gets 10 Years in Jail

In Ocala, Florida, a co-defendant who was charged in connection with a double homicide pleaded to no contest to lesser charges last Friday. In exchange, he agreed to testify against the fourth and final remaining defendant in the homicide case.

Twenty-eight year old Carlose Arrellano was originally charged with two counts of first-degree murder. However, after pleading no contest to being an accessory after the fact to the first-degree murder and conspiracy to commit murder (both considered first-degree felonies), the native of Mexico was sentenced to a decade in the Florida Department of Corrections and another ten years of probation.

Court records show that Arrellano was arrested in Chicago earlier this summer and extradited to Florida where he was formally charged. Authorities believe that the December, 2001 double murder was a drug-related homicide.
